About The Klub
The Klub is an online talent discovery and opportunity platform. The Klub provides a marketplace connecting talent with brands and agencies. The Klub is a technology platform only. We are not a recruitment agency, talent agency, employer, or party to any agreement entered into between brands and talent through the platform.
The Klub is a marketplace, not a party to agreements
All agreements, bookings, and arrangements made through The Klub are solely between the brand and the talent. The Klub does not employ, represent, endorse, or guarantee any talent or brand. We are not responsible for the conduct, performance, quality, or reliability of any user. Any dispute arising from a booking is between the brand and the talent. The Klub may at its discretion assist in mediation but accepts no liability for any outcome.
Brief and project misunderstandings
The Klub accepts no liability for any misunderstanding, misinterpretation, or dispute arising from a project brief, scope of work, deliverables, or any other commercial terms agreed between brands and talent. It is the sole responsibility of both parties to ensure all terms are clearly agreed in writing via the platform's booking and agreement tools prior to commencing work. The Klub strongly recommends all project details, deliverables, timelines, usage rights, and payment terms are confirmed through the platform's eSign agreement feature before any work begins.
Talent classification
Talent using The Klub are independent contractors. Nothing in these terms creates or implies an employment relationship, worker status, or agency relationship between talent and any brand, or between talent and The Klub. Talent are solely responsible for their own tax, national insurance, and any other statutory obligations arising from fees received.
Platform fees and payments
The Klub charges a platform fee on all transactions processed through the platform. Fee rates are displayed at the point of booking and on the pricing page. Fees are deducted automatically at source at the point of fund release from escrow. Both brands and talent acknowledge and agree to the applicable fee structure upon registration. The Klub uses Stripe as its payment processor. By using payment features you also agree to Stripe's terms of service.
Escrow and fund release
When a booking is confirmed and payment is made, funds are held in escrow pending job completion. Funds are released upon mutual confirmation of completion by both parties. In the event of non-response within 72 hours of one party marking a job complete, funds may be auto-released at The Klub's discretion. The Klub is not a financial institution and does not provide regulated financial services. Escrow services are provided through Stripe Connect.
Disputes and refunds
All refund and dispute requests must be submitted through the platform's dispute mechanism within 14 days of the project end date. The Klub will review disputes and may request evidence from both parties. The Klub's decision on disputes is final.
Reviews
Reviews must be honest, fair, and based on genuine experience. Reviews that are defamatory, discriminatory, or in breach of these terms may be removed at The Klub's discretion. Users may not offer incentives in exchange for positive reviews.
Content and profiles
Users are responsible for all content uploaded to the platform. By uploading content you grant The Klub a non-exclusive licence to display that content on the platform. You confirm you own or have the right to use all content you upload. The Klub reserves the right to remove content that violates these terms, applicable law, or third party rights.
Prohibited conduct
Users must not: misrepresent their identity, experience, or credentials; engage in discriminatory, abusive, or harassing conduct; circumvent the platform to avoid fees; share another user's personal data without consent; post false or misleading information; or use the platform for any unlawful purpose. Violations may result in immediate account suspension.
Limitation of liability
To the fullest extent permitted by law, The Klub shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the platform. The Klub's total liability to any user shall not exceed the total fees paid by that user to The Klub in the 3 months preceding the event giving rise to the claim.
Data protection
The Klub processes personal data in accordance with our Privacy Policy and the UK General Data Protection Regulation (UK GDPR).
Governing law
These terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to terms
The Klub reserves the right to update these terms at any time. Users will be notified of material changes by email. Continued use of the platform after notification constitutes acceptance.
