Terms of Business - Brands

1. Introduction

These Terms of Business ("Terms") govern your use of The Klub platform as a registered brand. By creating an account, you agree to be bound by these Terms. The Klub connects brands with vetted professional talent for projects including live commerce, events, brand ambassadorship, and more.

2. Registration

You must provide accurate company information during registration. You represent that you have the authority to bind your organisation to these Terms. Your company profile and project briefs will be visible to talent on the platform.

3. Discovery & Matching

You may browse talent profiles, apply filters, and express interest by "swiping right" on profiles. If the talent accepts your interest, a match is created. Matching does not constitute a contractual obligation from either party.

4. Bookings & Payments

When you create a booking, you agree to pay the agreed rate plus the platform fee (currently 15%) upfront via the platform's payment system. Funds are held in escrow until the project is marked as complete. Refund requests must be made within 48 hours of project completion and are subject to review.

5. Project Briefs

You are responsible for providing clear, accurate project briefs including scope of work, duration, location, and any specific requirements. Talent reviews include criteria on whether the brief was clear, which affects your brand's trust score.

6. Feedback & Reviews

After each completed project, you are required to complete a mandatory professional review of the talent. Reviews are double-blind and cover punctuality, preparedness, professionalism, brand representation, and audience engagement. This system is fundamental to the platform's quality assurance.

7. Communication

All project-related communication must occur through The Klub's messaging system. Attempting to take arrangements off-platform is prohibited and may result in account suspension.

8. Talent Rights

Talent engaged through The Klub are independent contractors, not employees. You must not misrepresent the nature of the working relationship. Any intellectual property arrangements for specific projects must be agreed separately.

9. Cancellation

Bookings cancelled less than 48 hours before the scheduled date may be subject to a cancellation fee of up to 50% of the agreed rate. The Klub will mediate cancellation disputes.

10. Termination

You may close your account at any time. The Klub reserves the right to suspend or terminate accounts that violate these Terms. Outstanding booking obligations will be honoured.

11. Limitation of Liability

The Klub is not liable for the quality of talent's work or any losses arising from projects, except where caused by our negligence. Our maximum liability is limited to the platform fees paid in the preceding 12 months.
